A West Virginia couple was awarded $564,000 last week in a medical malpractice lawsuit. Angela and Ralph Eldridge filed a lawsuit against Dr. Aryeh L. Herrera and Allegheny Plastic Surgery. Angela experienced complications during a reconstructive breast surgery in 2011. After a five-day trial, the Washington County jury agreed with the Eldridge’s that Herrera did not provide the acceptable level of care and that his negligent actions inflicted Angela with injuries.
According to the complaint, in 1993 Angela had a double mastectomy and reconstructive surgery where her breast tissue suffered necrosis. Eldridge decided to have another surgery in December 2010 by Herrera and the results caused deformities, asymmetry, and other issues. Herrera performed a corrective surgery in February of 2011 that resulted in additional necrosis to the breast tissue. The lawsuit stated that Herrera failed to warn her of the heightened risks of the surgeries, and he also neglected to obtain informed consent from Eldridge. Due to the negligence of Herrera, Eldridge was required to have additional surgeries resulting in unnecessary medical expenses, lost wages, and mental anguish. The jury agreed and awarded the Eldridge’s with $64,000 for expenses related to the injuries and $500,000 for non-economical damages.
