A lawsuit against the City of Highland Park, Illinois is resuming after the Illinois Supreme Court determined that a municipality can be held liable for poor conditions on bicycle trails. The cyclist who is pursing the suit was injured in the bicycle accident in August 2013. She was on an early morning ride with her cycling group when another cyclist had fallen after hitting bumps in the pavement. She rode over that cyclist and was thrown from her bicycle. According to her attorney, there were tree roots growing under the sidewalk and were not visible until you were riding over them. The cyclist had several broken ribs, a punctured lunch forearm and head injuries, and a broken wrist. The Illinois Supreme Court reported that immunity from these incidents does not apply to trails that are covered with asphalt, crushed aggregate, concrete or any comparable surfaces.
